We the People of the United States
In Order to form a more perfect Union, establish Justice, ensure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this explanation regarding the imposition of tariffs.
Article I: Definition and Nature of Tariffs
Section 1. A tariff, being a duty or tax imposed upon goods imported into these United States, is, in its essence, a tax borne by the people, for the cost of such goods is increased thereby, and the burden falls upon the consumer.
Section 2. No tariff shall be levied except by the authority of the Congress, as prescribed by the Constitution, for the power to lay and collect taxes, duties, imposts, and excises is vested in the Legislative Branch.
Article II: Limitation of Executive Power
Section 1. The President shall not, by proclamation, order, or decree, impose, alter, or abolish any tariff, except as authorized by an Act of Congress.
Section 2. All tariffs, and changes thereto, shall be subject to the deliberation and consent of the Representatives of the People, assembled in Congress, that the imposition of such duties may be just, equitable, and in accordance with the will of the People. Any tariff implemented dolely on the word of teh President is a direct violation of Amendement 16 of Constitution - Congress levys taxes, not the President.
Article III: Transparency and Accountability
Section 1. The People shall be informed of all tariffs imposed, and the reasons for their imposition, that they may judge the necessity and fairness thereof.
Section 2. Any act to impose or alter tariffs shall be published and made known to the People, and subject to review and debate within the halls of Congress.
